CHRONIQUE DE GUANTANAMO

  1. Le 7 février 2002, Human Rights Watch (HRW) confirme que tous les détenus ont droit à la protection de la convention de Genève même si on détermine par la suite que certains ne sont pas des prisonniers de guerre : Bush se trompe sur les dispositions des Conventions de Genève.

  2.  Le 8 février 2002, la Commission internationale des juristes (International Commission of Jurists) déclare dans un communiqué de presse : Bush decision on prisoner of war status is incorrect in law (La décision de Bush concernant le statut des prisonniers de guerre est juridiquement incorrecte).

    Amnesty International urged the United States to ensure respect for the human rights of all people who have been or may be transferred from Afghanistan to a US military base in Guantánamo Bay, Cuba.
    All those in US custody following the military operations in Afghanistan must be treated humanely, with full respect for international standards. Housing detainees in Guantanamo in 6x8 feet chain-link "cages" at least partially open to the elements falls below minimum standards for humane treatment.

    Enchaînés, cagoulés et sous tranquillisants… 
    les premiers prisonniers talibans ou du réseau Al-Qaida, capturés en Afghanistan, sont arrivés, vendredi 11 janvier, sur la base américaine de Guantanamo, à Cuba. Ce premier transfert de vingt hommes s'est effectué dans des conditions de sécurité exceptionnelles et laisse entières les interrogations sur le statut de ces détenus que Washington considère comme des "prisonniers du champ de bataille".

    Under President Bush's November 13th Military Order on military commissions, any foreign national designated by the President as a suspected terrorist or as aiding terrorists could potentially be arrested, tried, convicted and even executed without a public trial, without adequate access to counsel, without the presumption of innocence or even proof of guilt beyond reasonable doubt, and without the right to judicial appeal.
